Mobile App EULA

1. Agreement and Acceptance

This End User License Agreement (“EULA” or “Agreement”) governs your download, installation, and use of the Figur mobile application on iOS and Android devices (the “App”). By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not download, install, or use the App.

Use of the figur.fit website and Figur’s business-to-business services (catalog ingestion, Shopify plugin, API, dashboard) is governed by our separate Website Terms & Conditions. Personal data we process in connection with the App is described in our Mobile App Privacy Policy.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. Your Account

The App may require an account, which you can create using email, phone (one-time password), Sign in with Apple, or Google Sign-In. You are responsible for keeping your credentials confidential and for all activity under your account. We may suspend or terminate accounts involved in misuse, fraud, or violation of this EULA.

4. Description of the Service

The App is a consumer AI virtual try-on experience. Features include uploading photos for try-on, generating virtual try-on outputs, building a wardrobe, requesting HD renders, and receiving styling suggestions. Use of certain features requires a paid subscription or credit pack purchased through the in-app stores.

5. AI-Generated Output

Try-on images, edits, and styling suggestions produced by the App are automated predictions. They may not always be accurate, realistic, or suitable for any particular purpose. Figur does not guarantee the correctness, reliability, or fitness of any AI-generated output. You agree to use such outputs at your own discretion and risk.

6. User Content and License to Figur

You retain ownership of any photos, garment images, or other content you upload to the App (“User Content”). By uploading, you grant Figur a non-exclusive, royalty-free, worldwide license to host, store, process, and analyze your User Content solely to provide and improve the Service. Use of your User Content for service improvement is on an anonymized and aggregated basis. You may withdraw this license at any time by deleting your account, after which your User Content will be removed within the timelines stated in the Mobile App Privacy Policy.

7. Acceptable Use

You agree not to upload, post, or use the App to:

• Upload nude, sexually explicit, or hate-based content;
• Upload images of any person under 18 years of age;
• Impersonate any individual or misuse another person’s likeness without their consent;
• Upload copyrighted images, garments, or designs without authorization;
• Reverse-engineer, decompile, or attempt to extract source code or model weights from the App;
• Scrape, automate, or otherwise circumvent rate limits or paywalls;
• Use the App for any unlawful, fraudulent, or deceptive purpose.

We may suspend, terminate, or remove content that violates these rules, with or without notice.

8. In-App Purchases and Subscriptions

8.1 Available products

The App offers a recurring auto-renewing subscription (“Figur Pro”) and one-time consumable credit packs. The features unlocked by each product are described in the App at the point of purchase.

8.2 Pricing

Prices are displayed in your local currency at the point of sale, set within Apple App Store and Google Play pricing tiers. We may change pricing or product configurations with reasonable prior notice.

8.3 Auto-renewal terms

Figur Pro is an auto-renewing subscription. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. The renewal fee will be charged to your Apple ID or Google account within 24 hours of the period end. You can manage and cancel your subscription at any time:

• iOS: Settings → your name → Subscriptions, or via the App Store app.
• Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions.

8.4 Free trials

If we offer a free trial, the trial converts to a paid subscription at the end of the trial period unless you cancel before then. The applicable subscription fee will be charged on conversion.

8.5 Credits

Credits are consumable virtual items that are added to your Figur account on purchase and consumed as you use the Service. Credits are non-refundable except as required by applicable law. Credits do not expire while your account remains active; on account deletion, any remaining credits are forfeited.

8.6 Refunds

Refunds for in-app purchases are handled by Apple or Google, not Figur. For Apple App Store purchases, request a refund at reportaproblem.apple.com. For Google Play purchases, use the refund flow in the Play Store. Figur cannot directly refund purchases made through Apple or Google.

8.7 Cross-platform purchases

Purchases and subscriptions made on one platform (e.g., iOS) may not be transferable or restorable on another (e.g., Android). Where possible, we associate entitlements to your Figur account so that you can access purchased features on multiple devices on the same platform.

9. India-Only Service Notice

The App is currently offered only in India. If you access the App from outside India, this Service is not directed to you and we do not actively offer it in your jurisdiction. Where mandatory local laws nonetheless apply (for example, the EU General Data Protection Regulation, the UK Data Protection Act, or the California Consumer Privacy Act), contact us at team@figur.fit and we will respond to lawful requests in good faith.

10. Account Deletion and Data Retention

You can delete your Figur account from within the App: Account → Delete Account. On deletion, your account is immediately disabled and your data is permanently removed within 30 days, subject to retention required by applicable tax, accounting, or audit law. You may restore a deleted account during the 30-day window by emailing team@figur.fit from your registered address.

Subscriptions: on iOS, Apple does not permit Figur to cancel your subscription on your behalf — you must cancel it in your Apple ID Subscriptions settings before deleting your account, or it will continue to renew. On Android, Figur cancels active subscriptions automatically as part of account deletion.

11. Intellectual Property

All intellectual property rights in the App, the Figur platform, AI models, branding, code, and design belong to Lavee Singh d/b/a Figur (and, after assignment, to Figur Technologies Pvt. Ltd.). Subject to your compliance with this EULA, we grant you a personal, non-transferable, non-exclusive license to install and use the App on devices you own or control. You may not copy, reproduce, modify, sublicense, or distribute any part of the App or Service without our written consent.

12. Disclaimers and Limitation of Liability

The App is provided “as is” and “as available.”To the fullest extent permitted by applicable law, Figur disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

To the fullest extent permitted by applicable law, Figur’s total cumulative liability under or in connection with this EULA shall not exceed the greater of (a) ₹1,000 or (b) the total amount paid by you to Figur in the twelve (12) months preceding the event giving rise to the claim. In no event shall Figur be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profit, or business opportunity.

Nothing in this EULA limits or excludes liability that cannot be limited or excluded under applicable law, including non-waivable consumer-protection rights.

13. Indemnification

You agree to indemnify and hold harmless Figur, its affiliates, and (after assignment) Figur Technologies Pvt. Ltd. from any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of your use of the App, your User Content, or your violation of this EULA.

14. Termination

We may terminate or suspend your account and access to the App if you breach this EULA or misuse the Service. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination — including Sections 6, 11, 12, 13, 15, and 17 — will survive.

15. Governing Law

This EULA is governed by the laws of India, and any disputes arising under it are subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka. If you are a consumer resident in a jurisdiction whose mandatory laws override this clause, those mandatory laws apply to you to the extent required.

16. Changes to this EULA

We may update this EULA from time to time. Material changes will be communicated in the App and through the app stores. Your continued use of the App after a change takes effect constitutes acceptance of the updated EULA.

17. Additional Terms for App Store Users (Apple)

The following additional terms apply to your use of the App on Apple iOS devices. Where the terms in this Section 17 conflict with the terms above, the terms in this Section 17 prevail for App Store users only.

17.1 Acknowledgement

You acknowledge that this EULA is concluded between you and Figur (Lavee Singh d/b/a Figur) only, and not with Apple Inc. (“Apple”). Figur, not Apple, is solely responsible for the App and its content.

17.2 Scope of License

The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

17.3 Maintenance and Support

Figur is solely responsible for providing any maintenance and support services with respect to the App, as specified in this EULA or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services in connection with the App.

17.4 Warranty

Figur is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Figur’s sole responsibility.

17.5 Product Claims

Figur, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.

17.6 Intellectual Property Rights

In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Figur, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that intellectual-property infringement claim.

17.7 Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

17.9 Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App. For example, if you have a wireless data services agreement, you must not be in violation of that agreement when using the App.

17.10 Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

18. Additional Terms for Google Play Users

Your download and use of the App from Google Play is also subject to the Google Play Terms of Service. Refunds and cancellations for purchases made through Google Play are handled by Google according to its policies. Google is not a party to this EULA and is not responsible for the App or its content.
